1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the services provided by Ahnak.AI (“we”, “us”, “our”), including our website, automation services, AI-powered communication systems, dashboards, and related offerings.
By accessing our website or engaging our services, you agree to be bound by these Terms.

Ahnak.AI provides AI-powered automation, lead handling, messaging, and business process optimization services for businesses operating around the world, primarily in Australia.
Unless stated otherwise, all services are provided under Australian law.
3. Services Provided
Ahnak.AI may provide services including (but not limited to):
- AI voice call handling (inbound and outbound)
- SMS, chat, and messaging automation
- Appointment scheduling automation
- Lead capture, qualification, and routing
- Sales pipeline and reporting dashboards
- Reputation and review automation
- Funnels and landing pages
- Business automation workflows
The specific services included depend on the package selected and agreed in writing.
Certain services may involve automated or AI-assisted phone calls, SMS, chat, or messaging. You acknowledge that these communications may be recorded, transcribed, analyzed, or logged for service delivery, quality assurance, and reporting purposes.
4. No Guarantee of Results
While our services are designed to improve responsiveness, efficiency, and lead conversion:
- We do not guarantee specific business outcomes, revenue increases, lead volume, or conversion rates.
- Results depend on factors outside our control including market conditions, customer responsiveness, pricing, staff availability, and service quality.
Any examples or projections shown (including calculators or case scenarios) are estimates only.
5. Client Responsibilities
You agree that you:
- Provide accurate, lawful, and up-to-date information.
- Comply with all applicable laws, including privacy and spam laws.
- Obtain required customer consents for calls, SMS, and messaging.
- Are responsible for the accuracy of content used in automations.
- Remain accountable for decisions made using automation outputs.
You remain the data controller of your customer data at all times.
You are solely responsible for ensuring that all customer communications comply with applicable laws, including the Spam Act 2003 (Cth) and Do Not Call Register Act 2006 (Cth), and that valid consent has been obtained where required.
6. Communication & Consent Compliance
You acknowledge that:
- SMS, calls, and messaging are subject to Australian laws including the – Spam Act 2003 (Cth) and Do Not Call Register Act 2006 (Cth).
- You are responsible for ensuring lawful consent is obtained before contacting customers.
- Ahnak.AI is not liable for penalties or breaches arising from improper consent or misuse.
7. Fees & Payment
- Fees are charged as agreed in your selected package or proposal.
- Setup fees (if applicable) are non-refundable.
- Monthly fees are billed in advance unless otherwise agreed.
- Late or failed payments may result in service suspension.
All prices are in AUD, exclusive of GST unless stated otherwise.
We may suspend or restrict access to services if payments fail, are reversed, or remain overdue, without liability for any resulting service interruption.
8. Cancellations & Termination
You may cancel your subscription by providing written notice in accordance with your plan terms.
We may suspend or terminate services if:
- Payments are overdue
- Terms are breached
- Services are misused or used unlawfully
Upon termination, access to systems and data may be removed after a reasonable transition period.
9. Intellectual Property
All intellectual property related to:
- Workflows
- Automations
- Templates
- System configurations
- Documentation
Remain the property of Ahnak.AI, unless expressly agreed otherwise in writing.
You are granted a limited, non-exclusive licence to use the services during your active subscription.
10. Data & Privacy
We handle personal information in accordance with:
- Privacy Act 1988 (Cth)
- Australian Privacy Principles (APPs)
Please refer to our Privacy Policy for details on how data is collected, stored, and used.
For customer data processed through the services, you remain the data controller and Ahnak.AI acts as a service provider.
11. Third-Party Platforms
Our services rely on third-party infrastructure for messaging, telephony, hosting, and automation.
We are not responsible for:
- Outages, delays, or limitations caused by third-party providers beyond our reasonable control.
- Changes in third-party pricing or functionality.
- External service disruptions beyond our control.
12. Limitation of Liability
To the maximum extent permitted by law:
- We exclude all warranties except those required under Australian Consumer Law.
- Our liability is limited to re-supplying the services or refunding the amount paid.
- We are not liable for indirect, consequential, or economic loss.
Nothing in these Terms limits rights under Australian Consumer Law that cannot be excluded.
AI-generated outputs and automation actions are provided as assistive tools only and must not be relied upon as legal, financial, compliance, or professional advice.
13. Indemnity
You agree to indemnify Ahnak.AI against claims, losses, penalties, or damages arising from:
- Breach of these Terms.
- Unlawful use of services.
- Breach of privacy, spam, or consumer laws.
14. Confidentiality
Both parties agree to keep confidential information secure and not disclose it without consent, except where required by law.
15. Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including system outages, natural disasters, or regulatory changes.
16. Changes to Terms
We may update these Terms from time to time. Updated versions will be published on our website and apply from the date stated.
17. Governing Law
These Terms are governed by the laws of Victoria, Australia.
You submit to the exclusive jurisdiction of the courts of Victoria.
